UK Mobile Phone - Driving Legislation
The penalty for drivers caught using a hand mobile phone or similar device while driving increases from £ 30 to £ 60, plus three penalty points on Feb. 27. Drivers face the same penalty, unless they have proper control of a vehicle, for example if they are distracted by using a mobile phone - even hands free. If the case goes to court in these circumstances, the maximum fine is £ 1,000 for drivers of cars and £ 2,500 for drivers of vans, lorries, buses and coaches. Employers and the law which causes or permits another person to use a handheld mobile phones while driving is illegal. The guidelines say that employers would not be included, simply because a cell phone call or because an employee who was driving. However, employers would probably be liable if their employees use a handheld phone while driving, and may be liable even if not prevent employees from using cell phones while driving on company business. The maximum penalty for "causing or allowing" are the same for using a mobile phone at the wheel - £ 1000 to £ 2500 for cars and vans, buses and coaches. Crimes government research found 92% of people in accordance with the law on mobile phones from vehicles, but 21% of drivers admit breaking. However, nearly 74,000 fixed penalty notices issued for crimes committed in the first year of law. Depending on the circumstances, police can charge drivers of other crimes and violate the law of mobile telephony. Drivers can be charged with driving without due care and attention, not having proper control of the vehicle or dangerous driving. The investigation of any accident involving death or serious injury, police are now examining phone logs as a matter of course. If you think a call may have been a contributing factor to the police should not distinguish between hand or use speakerphone. Research shows that drivers are four times more likely to have an accident while talking on the phone while driving. The law is illegal for a driver using a handheld phone or similar device (like a PDA or Blackberry), while in a car with the engine running. This includes waiting at traffic lights or when stuck in traffic. The only exception is if a driver uses the phone to call emergency services. Passengers can use mobile phones unless they are supervised by a learner driver. Even if a phone is equipped with a remote receiver or speaker and microphone, it is illegal to hold while you dial a number or answer a call. Click the buttons is allowed, but the phone must be mounted in a cradle on the dashboard. The text messages or access the Internet from a mobile device, while control of a vehicle is covered by the law because some units use portable satellite navigation. Two way radios, are not covered by legislation. The guidelines on best practices? Advise drivers to keep their phones while driving out of use or voicemail and call forwarding to carry the message to respond when you are driving? Instruct employees in writing not to use handheld mobile phones while driving on company business? Get a signed copy of the policy of the mobile phones of employees - the company may one day have to demonstrate that pilots are prohibited from using mobile phones while driving.
